Terms & Conditions

By participating in Caché’s Treasured Loyalty Program, you agree to the following Terms and Conditions. Caché may from time to time change the Terms and Conditions, and those changes shall be effective as of the date that the new Terms and Conditions are posted at www.cache.com/treasured-rules or otherwise communicated to you.

Membership

To participate in the Caché Treasured Loyalty Program (“Treasured Program”), you must be 13 years of age and have a valid email address. Children under the age of 13 may not submit or provide any information about themselves through the Treasured Program. An application for the Treasured Program can be obtained at any Caché store, online at www.cache.com/treasured or by calling Caché Customer Service at 1-800-788-Cache. In order to complete your enrollment in the program, you must go to www.cache.com/treasured and complete your personal profile and opt into the program. Email address is required to receive a reward. International members are required to identify themselves as international via their profile at www.cache.com/treasured. The information you provide in the enrollment process and information we gather as part of your participation in the program will be collected and used as described in our Privacy Policy at www.cache.com/concierge/privacy-policy. Only one membership account per person is permitted.

The Treasured Program replaces the Caché Accents Program which will be discontinued as of March 13, 2014 and any customer currently enrolled in the Accents Program must enroll in the Treasured Program online at www.cache.com/enroll to participate in the Treasured Program.

Qualifying Purchases

All purchases made at either a Caché store or online are considered a Qualifying Purchase except for the following (1) purchases made using a gift card or (2) purchases made with an employee discount. The purchase of a Caché gift card constitutes a Qualifying Purchase.

Earning Points

Once a customer is enrolled in the Treasured Program the customer will begin to earn points based upon Qualifying Purchases. For every dollar spent at a Caché store or online, a customer will receive two (2) points (“Points”). If the Qualifying Purchase is made at a Caché store, the customer may voluntarily provide their name and zip code as it appears on their membership account in order to receive points for the Qualifying Purchase, unless where prohibited by law. Upon completion of the profile information online, all new members will receive a onetime award of 100 points. In addition to earning points for Qualifying Purchases, members will also be awarded other bonus point opportunities during the year.

Quarterly Earning Period

Members’ points will be accumulated during the following periods of time: January 1st - March 31th, April 1st - June 30th, July 1st - September 30th, October 1st - December 31st. ***In 2014, due to the launch of the Treasured Program, the initial quarterly earning period will be March 15th - June 30th.

Rewards

At the end of each quarterly period, members who have earned a minimum of 500 points during that quarter will receive a Caché reward certificate (“Certificate”) which must be used at a Caché store or online within one hundred twenty (120) days from receipt of the Certificate online. Members who live outside of the United States will receive a Caché reward certificate which must be used at a Caché store or online within three hundred and sixty-five (365) days from receipt of the Certificate online. The amount of the Certificate will be determined by the number of points earned during that quarter. Members can obtain their certificate via email or by going to your Caché Treasure account at www.cache.com/treasured. The Certificate may only be used by the individual whose name appears on the Certificate.

If at the end of a Quarterly Earning Period, there are points remaining in a member’s account, these points will be rolled over into the next Quarterly Earning Period.

A member’s account is reset at zero at the beginning of each calendar year and any remaining Points at the end of each calendar year will be forfeited.

Treasured Luxe

A member will automatically be upgraded to the premier tier of the Treasured Program (“Treasured Luxe”) when that member has $3,000 in Qualifying Purchases in a calendar year. Any member who has a Caché Visa credit card will be entitled to Treasured Luxe status.

Communications

By providing your contact information, you agree to receive marketing communications, including offers and promotional messages, from Caché. You may opt out of receiving these communications by updating the member’s My Account / Account Info section of their Caché online account or calling 1-800-788-CACHE (2224). You may also opt out of receiving email communications by following the opt out instructions contained in our emails to you.

Cancellation

Caché may cancel your Membership at any time for any or no reason by notifying you. Any points remaining in your account as of the termination will qualify you for a Certificate, if you have reached the required amount to qualify for a Certificate, but you will not be credited for purchases made after the termination. You may cancel your participation in the Treasured Program by notifying Member Services by email or phone. Cancellation may take up to 10 weeks to finalize. Upon cancellation, membership will be deactivated and any Points or unissued Rewards will be forfeited.

Abuse

Abuse of the Program, including failure to follow or any attempts to circumvent Program policies and procedures or these Terms, or other improper conduct as determined by Caché in its sole discretion, is strictly forbidden. Abuse may result in cancellation of the Member's account, future disqualification from Program participation, forfeiture of some or all Rewards accrued, cancellation of previously issued but unused Rewards and liability for past amounts of Rewards redeemed. In addition, Caché reserves the right to take appropriate legal action as it deems necessary or desirable. The sale, barter or transfer of Rewards, except by Caché, is expressly prohibited.

General

Rewards may be used with other rewards issued pursuant to the Treasured Program, including a birthday bonus, “Surprise and Delight” and other bonuses and may be used in conjunction with most other discounts (excluding employee discounts), and promotions or offers towards the purchase of merchandise. Treasured accounts are limited to one account per eligible customer; each email address and mailing address is also limited to one account. Rewards are nontransferable and may only be redeemed by the Member.

Caché reserves the right to modify, revise or cancel this Program, the Terms or any part of the Program at any time for all participants or for any specific participant without prior notice. Caché’s decision on any aspect of Member's account, membership status, Rewards balance or any aspect of the program or a particular Member's participation in it shall be final. For the purposes of Rewards issued under this program.

Limitation of Liability

CACHÉ SHALL NOT BE LIABLE FOR ANY CLAIMS, ACTIONS, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY OR DEATH, RESULTING FROM THE TREASURED PROGRAM. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. YOU ACKNOWLEDGE AND AGREE THAT CACHE HAS NOT MADE AND IS NOT IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE), IN FACT OR IN LAW, RELATIVE TO THE TREASURED PROGRAM. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, CACHE DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO CACHE.COM AND CACHÉE SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS RELATED THERETO.

Governing Law

These Terms and Conditions and the Treasured Program will be interpreted, construed and enforced, and governed in all aspects in accordance with the laws of the state of New York. Any cause of action arising under or relating to these Terms and Conditions will be brought exclusively in a court in New York City, New York and you consent to the exercise of exclusive jurisdiction by and exclusive venue in such courts. You waive any right to trial by jury and agree that any claim brought by you in connection with the Treasured Program may not and will not be made the subject of a class action.

How do I become a member of Treasured?

Joining is easy and free. You can fill out an enrollment form at any Caché store, go online to Cache.com/enroll or call customer service at 1-800-788-CACHE (2224). Regardless of where you enroll, remember to update your contact information within your My Account / Account Info section in order to enjoy all the benefits of the program. Email address will be necessary for program enrollment.

Does it cost anything to become a member of Treasured?

I am currently an Accents member, what do I need to do to be part of Treasured?

All members currently enrolled in the Caché Accents Program are required to enroll into the Treasured Program. Enrollment is easy. Fill out an enrollment form at any Caché store, go online to Cache.com/enroll or call customer service at 1-800-788-CACHE (2224).

I am a Caché Visa cardholder, what do I need to do to be part of Treasured?

I applied in store; do I need to do anything else?

Congratulations you have enrolled in Treasured. We strongly recommend that you complete your profile online to enjoy all the benefits of the program. To complete your profile, simply go into your online account via Cache.com/Treasured to update your My Account / Account Info section. Remember to update your email address and birthdate in order to receive your rewards in a timely fashion.

What do I get for being a Treasured member?

Here’s the great news, you’ll earn 2 points for every $1 spent at every Caché store and online at Cache.com. In addition, you’ll earn bonus points for completing your profile within your My Account / Account Info section (sign into your Cache.com account). And throughout the year you’ll receive member only coupons, priority notice of new items and promotional events, a birthday surprise, bonus point opportunities and more!

I was told that I qualify for Treasured Luxe, what does that mean?

How do I become a Treasured Luxe member?

Treasured Luxe membership is reached by either spending $3,000 or more from January 1 – December 31 or by being a Caché Visa cardholder.

How do I track my point balance?

Log into your Cache.com account, and on the top hand panel on the right, you will have a “Treasured” button which will direct you to a dedicated page with your Treasured account activity.

When do I earn points?

You have an opportunity to earn points every 3 months on the following schedule:
i. Spring: April 1* – June 30
ii. Summer: July 1 – Sept 30
iii. Fall: Oct 1 – Dec 31
iv. Winter: Jan 1 – Mar 31

*Note: In 2014, due to launch, points earned in March will be part of the Spring earning period.

How can I use my points towards a reward?

At the end of each season, you will automatically receive a reward based on the amount of points you’ve earned (see reward tiers below). All awards will be valid at any Caché store or via Cache.com. Expiration dates will be included in the reward email.

When should I expect to receive my award?

You will receive your award via email within 15 days of the earning season window ending. Make sure to update your My Account / Account Info section with your most current email address to avoid any delay.

What’s the difference between Treasured points and Caché Visa points?

Treasured allows you to earn points every time you shop, regardless of the form of payment you use. Caché Visa is a credit card that allows you to earn Caché Visa points every time you use your Caché Visa card to make a purchase (at Caché or wherever Visa is accepted). Currently, they are separate programs, and points are not combinable. Treasured members can also apply for a Caché Visa, and earn points in both programs. I lost my reward certificate, what can I do to replace it?

Reward certificates are emailed out at the end of each earning season, for accounts that have reached the required levels. They are also stored on your Treasured online account, simply sign into Cache.com/Treasured, and click on the “Treasured” tab to download.

Do I need to print out my reward certificate in order to use for an in store purchase?

No, but you do need to show the sales associate your digital reward certificate number before your purchase is made in order for them to apply towards your purchase.

I didn’t receive points for my recent shopping experience. How can I fix that?

Not a problem. Simply call customer service at 1-800-788-CACHE (2224). Make sure to have your receipt available.
